On the 8th day of October 1862, the Will of George Priestnall late of Bramhall in the County of Chester, Farmer and Wheelwright, deceased, was proved by the oath of John Cooke, one of the executors named in the said will, having been first sworn duly to administer. Power being reserved of making the like grant to Margaret Priestnall, Spinster the daughter of the said deceased. No other executor therein named when entitled thereto.
Will
This is the last Will and Testament of me George Priestnall of Bramhall in the County of Chester, Farmer and Wheelwright. I order and direct all my just debts and funeral and testamentary expenses to be paid by my Executors hereinafter named as soon as conveniently may be after my decease. I give and bequeath unto my dear wife Mary Priestnall the use and enjoyment of all the household goods and furniture which I may die possessed of during her life and also the use of any Cows I may leave at my decease during her life and I direct that as soon as convenient after my decease my Executors shall cause an Inventory to be made of the said effects and that my said wife sign the same.
I give and bequeath unto my friend, John Cooke of Bramhall aforesaid, Land Agent(whom I hereafter appoint an Executor of this my will), all my ready money, securities, goods, stock in hand, chattels, credits and personal estate and effects whatsoever and wherever (subject as to the use of my household and furniture and Cows by my said wife during her life), to hold the same unto the said John Cooke, his executors, administrators and assigns upon trust as soon as conveniently may be after my decease to sell and dispose of, collect and convert into money so much and such parts of the same personal estate as shall not consist of money or securities for money. I hereby empower the said John Cooke to compound for or allow such time and accept such security and or personal for the payment of any sum or sums of money which shall be owing to me at the time of my decease as by him shall be deemed expedient. And I hereby declare that the said John Cooke, his executors, administrators or assigns shall stand possessed of the monies to arise and be produced from my said personal estate as aforesaid. Upon trust (after payment of my just debts and funeral and testamentary expense and the expenses incident to the trusts of this my will), to lay out and invest the surplus of the same money in or upon Government or real securities in England with the power for my said trustees verify and transpose such securities as often as occasion shall require for others of a like nature.
And hereby direct and declare that the said John Cook, his executors, administrators and assigns shall receive the income and annual produce to arise from the investments hereinafter directed, upon trust to pay the same unto my said wife Mary for and during her life, she, my said wife maintaining thereof my daughter Mary Priestnall and from and after the decease of my said wife, upon further trust to pay the said income and annual produce unto or for the benefit of my said daughter Mary Priestnall for her life and from and after her decease, upon trust to call in the said trust funds and pay and divide the same into four equal parts one of which I give and bequeath to my daughter Margaret Priestnall, another of which parts I give and bequeath to my daughter Elizabeth Priestnall, another of which parts I give and bequeath unto and amongst the children of my late daughter Hannah Potts as equal shares if more than one and the remaining fourth part or share I give and bequeath unto the child of my late daughter Esther Potts but in the event of the decease of such child under the age of twenty one years I give and bequeath to third parts of the share provide for such child unto my daughters Margaret Priestnall and Elizabeth Priestnall and the remaining third of such share unto and amongst the children of said my late daughter Hannah Potts provided always and I hereby declare that it shall be lawful for my said trustee to apply the income of the share of any minor who may become entitled under this my Will for or towards his or her maintenance, education or bringing up and I give and devise all the real estate vested in me as trustee or mortgagee unto and to the use of the said John Cooke, his heirs and assigns subject nevertheless to the equities affecting the same respectively. And I hereby declare that all and every person who shall or may pay any sum or sums of money owing to my estate to the trustee of this my Will shall be exonerated from all responsibility in respect of the application thereof. And I hereby further declare that my executors shall not be answerable or accountable for the debts, receipts or defaults of the other of them nor for any loss which may happen to the said trust monies and premises unless the same shall happen by his or her own wilful neglect or default and that my said executors may reimburse themselves all such costs, charges and expenses as they or either of them may incur in the execution of the trusts of this my Will.
And I appoint the said John Cooke, Trustee and Executor of this my Will and my said daughter, Margaret Priestnall, Executrix if she shall return to this country and come to reside in the neighbourhood of Bramhall aforesaid.
In witness whereof I the said George Priestnall have to this my Last Will and Testament contained on this and the preceding sheet of paper, set my hand this fifteenth day of January one thousand eight hundred and fifty nine
