Will of Margaret Priestnall of Middlesex (Spinster) - Died 25th April 1864 at 15, Dorchester Place, Blanford Square in the County of Middlesex (Formerly of 24, Arlington Street, aforesaid)

Administration

Proven at the Principal Registry on the 15th July 1864 by the oaths of Elizabeth Burgess (wife of George Burgess), of Disley in the County of Chester, the sister, and James Downing (Draper) (eldest son of testatrix late uncle John Downing) of Mill Street, Macclesfield, in the said County of Chester, the executors to whom administration was granted.

Will

This is the last will and testament of me Margaret Priestnall of 24 Arlington Street in the County of Middlesex, Spinster, made and published this 16th day of April 1853 in manner following that is to say I direct all my just debts funeral and testamentary expenses to be paid by my executors hereinafter named as soon as conveniently may be after my decease and subject thereto I give and bequeath all my personal estate and effects whatsoever and wheresoever and of what nature or kind soever unto my sisters Elizabeth Priestnall of Bramhall near Stockport in the County of Chester, Spinster and Mary Priestnall of the same place, Spinster and the children of my deceased sisters, Hannah Potts late of Poynton in the said County of Chester, Deceased and Esther Potts late of Ashton under Lyne in the County of Lancaster, deceased, in manner following that is to say one moiety or equal half part thereof to be equally divided between my said sisters Elizabeth Priestnall and Mary Priestnall to and for their own absolute use and benefit and the other moiety or equal half part thereof to be  equally divided between and amongst such of the children of my said deceased sisters Hannah Potts and Esther Potts as shall be living at the time of my decease and the issue also living at the time of my decease of such of them as shall be then dead, as being a male or males shall have attained or hereafter shall attain the age of twenty one years or being a female or females shall have attained that age or been married or shall hereafter attain that age or be married equally share and share alike as tenants in common yet so nevertheless that my said nephews and nieces shall take per capita and not per stirpes but that the issue of any deceased  nephews or nieces shall take per stirpes and not per capita and so that such issue shall take by way of substitution the share or respective shares only where the parent or respective parents of such issue would if living have taken And if there shall be but one such child or other issue of my said deceased sisters then the whole to such one or only child or issue
And I do hereby appoint my said sister Elizabeth Priestnall and James Downing of Macclesfield in the County of Chester, Draper, eldest son of my deceased uncle John Downing Executrix and Executor of this my will. And I do hereby direct that the script or scripts in writing of my said executors for any sum or sums of money payable to them or him under or in virtue of  this my will shall be sufficient discharge or sufficient discharges for the same respectively or so much thereof respectively as in such script or scripts respectively shall be acknowledged to be received and that the person or persons to whom the same shall be given his her or their executors administrators and assigns shall not afterwards be answerable or accountable for any loss misapplication or non application or be in any way obliged to see to the application of the money herein expressed to be received. And I do declare that my said executors shall be charged and chargeable respectively for such monies only as they respectively shall actually receive by virtue of the trusts hereby in them or him reposed notwithstanding his or their giving or signing a receipt or receipts for the sake of conformity and shall not be answerable or accountable the one or the other of them but each only for his own acts and defaults respectively and that it shall and may be lawful for my said executors by and out of the monies which shall come to their respective hands by virtue of this my will to reimburse themselves and himself all costs charges damages and expenses which they or either of them shall or may suffer expense disburse or be put unto in or about the execution of the trusts hereof or in relation thereto. And I revoke all former will or wills by me at any time heretofore made and declare this to be my last will and testament. In virtue whereof I the said Margaret Priestnall the testatrix have to this my will contained in this and the next proceeding sheet of paper set my hand to and at the bottom of the said proceeding sheet and of this second and last sheet the day and year first hereinbefore written – April 16th 1853, Margaret Priestnall.

The writing contained in this and the next proceeding sheet of paper was signed by the above named Margaret Priestnall the testatrix as and for her will in the presence of us present at the same time who at her request in her presence and in the presence of each other have subscribed our names as witnesses,
