Will of Ann Priestnall of Stockport – Died 13th July 1886 at Stockport

Administration

Proved at Chester with a Codicil the 8th day of September 1886 by the oaths of The Reverend Absalom Clark, Minister of the Gospel and William Lees the Executors named in the Will to whom Administration was granted.
The testator, Ann Priestnall was of Shaw Heath, but late of Wellington Road South, both in Stockport in the County of Chester, Widow and died on the 13th day of July 1886 at Wellington Road South aforesaid.

Will

This is the last Will and Testament of me Ann Priestnall of Shaw Heath, Stockport in the County of Chester, Widow made this thirteenth day of August one thousand eight hundred and seventy nine. I appoint my friends, Absalom Clark of Davenport, Stockport, Minister of the Gospel and William Lees of Hobart Terrace, Stockport, Hat Manufacturer, Trustees and Executors of this my Will. I devise and bequeath all my estate and effects both real and personal of which I shall die possessed of or entitled to unto my said trustees their heirs executors and administrators. As to my furniture, plate, linen, china, pictures, prints, books and other household effects upon trust to divide the same between my daughters, Ann Elizabeth and Sarah Cullen in shares and proportions as nearly equal in value as may be such division to be made by my trustees according to the best of their judgement. And as to all other my estate and effects upon trust to sell and convert the same into money and to pay thereof my just debts, funeral and testamentary expenses and then to divide the residue into three parts or shares and as to one of such parts or shares to divide the same equally between and amongst the children of my daughter Mary Storer Wilde, deceased, the share of each child to be paid on his or her respectively attaining the age of twenty one years except the shares of William Dobson Wilde and Anna Wilde which I direct shall be held by my trustees and be invested by them on such trusts as they shall think proper. Upon trust to pay the income of such shares respectively to the said William Dobson Wilde and Anna Wilde during their respective lives and after the decease of either of the as to the capital of the share to him or her so dying upon trust for such person or persons and in such proportions as he or she so dying shall by his or her last Will appoint and failing any such appointment then upon trust for the person or persons who at the death of the said William Dobson Wilde and Anna Wilde respectively shall be of next of kin to him or her and who under the statutes for the distribution of testator effects would be entitled to his or her personal estate, if he or she (if a widow) had died intestate such persons if more than one to take in the shares presented by the same statutes. And as to one other third part of the residue of my said estate upon trust to invest the same in such securities as my said trustees or the survivor of them shall think proper and to pay the interest and dividends arising therefrom to my said daughter Ann Elizabeth for her life to be enjoyed by her during any and every coverture as her separate property free from marital control and without power of anticipation and from and after her decease as to the capital of the said one third part of my residuary estate with the interest thereon upon trust for such person or persons and in such proportions as she shall by her last will appoint and failing any such appointment then upon trust for the person or persons who at the death of my said daughter Ann Elizabeth shall be of next of kin to her and who under the statutes for the distribution of intestates effects would be entitled to her personal estate if she had died a widow and intestate such persons if more than one to take in the shares prescribed by the same statutes. And as to the remaining one third part of my said residuary estate upon trust to invest the same on such securities as my said such trustees or the survivor of them shall think proper and to pay the interest and dividends arising therefrom to my said daughter, Sarah Cullen for her life to be enjoyed by her during any and every coverture as her separate property free from marital control and without power of anticipation and from and after her decease as to the capital of the said one third part of my residuary estate with the interest thereon upon trust for such person or persons and in such proportions as she shall by her last will appoint and failing any such appointment then upon trust for the person or persons who at the death of my said daughter Sarah Cullen shall be of next of kin to her and who under the statutes for the distribution of intestates effects would be entitled to her personal estate if she had died a widow and intestate such persons if more than one to take in the shares prescribed by the same statutes. I declare that my trustees shall have full discretionary power to permit any part of my personal estate which shall at my decease consist of mortgage, stocks, funds, shares in Railway or other public companies including personal securities or any other species of investment yielding interest or income to remain in the same state of investment for such period or periods as my trustees shall think fit. I devise all estates vested in me as trustee or mortgagee unto my said trustees, their heirs and assigns subject to the trusts and equities affecting the same. I empower my trustees to apply all or any part of the income arising from the share of any child of my said daughter, Mary Storer Wilde for the maintenance and education of any such child during his or her minority. I declare that the expression “my trustees” used by me in this my Will shall be construed as comprising and referring to the trustees or trustee for the time being of this my Will and that the power of appointing new trustees of my Will shall be exercisable by the said Absalom Clark and William Lees and the survivor of them and after the death of the survivor of them by the persons and in manner by law presented and that the number of trustees of my Will may from time to time be varied but so that the number be not less than two nor greater than four.

Signed by Ann Priestnall of Shaw Heath, Stockport, in the County of Chester, Widow, as her last Will and Testament in the presence of us present at the same time who at her request in her sight and presence and in the presence of each other have hereunto subscribed our names as witnesses.

This is a Codicil to the written Will of me the within named Ann Priestnall. Whereas I have since the date of my said Will purchased the house with its appurtenances wherein I now reside situate and being in Wellington Road South, Stockport in the County of Chester. Now I hereof devise the said dwelling house with its appurtenances unto the within named Absalom Clark and William Lees their heirs, executors and administrators. Upon trust to permit and suffer my daughters, Ann Elizabeth and Sarah Cullen to use and enjoy the same or to receive the rents or profits during their joint lives and the life of the survivor of them and after the death of such a survivor then on trust to sell the same and stand possessed of the proceeds of such sale, upon further trust to pay and divide the same equally between all the children of my daughter Mary Storer Wilde, deceased, as tenants in common. In all other respects I confirm my said Will.
